My Association (sheltered housing)is reviewing its Rent Policy and I have been asked to update on where we are with Rent Officer referrals and RSLs in Scotland. We deal with 21 local authorities. Thus far, only one has used the potential for a referral to influence our rent-setting for a new scheme. However, with rent and service charge increases inevitably out-stripping inflation, the potential for further problems arises. I would be interested to know, under which statuatory ledgislation rents are referred to the RO.Only an act of parliament "per se" can be employed to disturb a valid contract. Perhaps you can ask them to define the same.
