immigration status and NiNo problems
Thu 07-Jul-05 01:22 PM

we have a tenant from pakistan who has full status to remain, who moved into property 03 with his wife who hasnt yet been granted status. home office have her passport and she hasnt been given a NiNo.

HB did start paying full rent for approx first 6 months but since have been making erratic payments and recovering them as O/P's for failing to provide info on his partner. apparantly hes expalined his proble to the office concerned

the tenant is in court on monday and facing eviction on ground 8 which is a mandatory ruling. im hoping to get this put aside til a later date if theres any hope of getting this sorted. however this case has only just been passed to me

is there anything the tenant can do to resolve his HB problem? he's due in a meeting with HB this afternoon but in case he doesnt get full advise from them, can anyone here offer any suggestions?

even if they dont recognise her as partner could they pay him as a single man with her as a non dep? or anything similar.

any help will be gratefully received, as id like to avoid him being evicted if possible

See if you can derive any assistance from CH/3801/2004. I'm sure Shawn or Ken can post a link, or you will find it on the Commissioner's website.

Paul

many thanks, there are some points in this decsion that seem to coincide with the case ive just been given. as ive only just been handed the case i dont have all the details on the tenant but from what i do know i think ican get the landlord not to proceed on ground 8, as i may be able to resolve this matter
