non commercial case
Fri 12-Jan-07 01:10 PM

I have a very cryptic reference to a case involving the issue of non commerciality (i.e. Reg 9 HBR) which involved Jesus College, cambridge. and, apperently, considered the issue of commerciality for classes of case v/s decsions made about individuals. Does anyone know which case this is?

Sorry if I am being out of order here, but are you certain it is not the Jesus Fellowship church case?

Also think it might be the Court of Appeal's judgment in Campbell and others v. South Northamptonshire District Council and Secretary of State for Work and Pensions (2004) now reported as R(H) 8/04.

There is a summary of R(H) 8/04 in the briefcase area of rightsnet that includes a link to the full decision itself.

(found this by doing a briefcase word search for 'Jesus').

Are you sure its not R v Rugby BC HBRB ex parte Harrison, a case involving the Jesus Fellowship?

Thanks to you all. Don't worry Jmembury you are not out of order at all. It did strike me that it could be one of the above cases involving the Jesus Fellowship but I'm not sure. The info came from a client who had attended a tribunal where the chair refered to this. Client was pretty clear that it was about Jesus College though which made me doubt myself! Guess I'll just have to await the SOR!

Well of course if the LSC would pay for you to attend the hearing you'd know. But then an appellant who is unable to follow what the Chair is saying about the name of the case, let alone the precedent established by it, couldn't possibly be at any disadvantage at the hearing could he?
