30/16 hour working disregard - non working partner disabled
Tue 26-Jul-05 04:28 AM

I have a couple. Mrs works 20 hours and is fit and able. Mr is retired and gets AA. I know the income disregard will be £20 but do they also qualify for the £14.50 16 hour disregard?? If they do they can claim a small amount of HB, if they don't their HB entitlement is nl.

Many thanks

the disability rights and CPAG books state;

the £14.50 disregard is applied if you, or your partner works 16 hours or more pw and your HB incldes the disability or higher pensioner premium.

your clients qualify in this respect

for couples, the partner for whom the premium is awarded must be the one working 16 hours weekly

in your example, as its the partner of the disabled person who is working, i think this disqualifies your clients
