Moving in delay for disability adaptations
Mon 20-Mar-06 02:03 PM

Single Client who was a non dependant had to enter into hospital. From there he accepts a tenancy but he cannot move in until the house is adapted.
I know the Regs allow for a 4 week delay but what happens when the work schedule runs over time ?
I know about the Commisioner Decision detailing a 24 hour period to stay but that may not be feasible either.
I also take it that the Discretionary payments are not allowed in these cases?

I seem to remember that one of the regular contributors to the forum recently reported on a case that been given occupation status (it was not in the housing forum but as an aside about the new CMS or similar)
but I cannot find it back and may well have misread
Any suggestions very welcome

Negtiate with the Landlord to waive the rent due,in the circumstances.

Ask Social Services for help

Look for charitable trusts who may be able to help

Dont think it will help all that much but it was held in R(H)9/05 that where a person was in hospital she was to be considered to be occupying her new home from the time her relatives moved her furniture in.

The Commissioner also debuked the myth that an overnight stay was necessary.

Is that the decision you had in mind?

Thanks very much.I thought it was more recent than this, but yes this will be the relevant one, because it establishes the principle that the claimant does not personally have to be there.
