Clt has telephoned me to say she has been turned down for a Funeral payment for her Mother, as her Brother who also lives in the same houshold gets Incapcity(not a qualifying benefit), so he is responsible rather than clt who gets Income Support? Brother is only on low income IB/DLA, and certainly won't have savings.

Does your client get HB/CTB for the household?

If the Brother could claim and get HB or CTB he'll be able to claim the funeral payment.

Hi, no unfortunately not, i thought this might be a possible way round it, but his sister(not him) has taken over tenancy of the property. I don't think there is any getting round this unless he can get a tenancy and claim IS/HB/CTB fairly quickly. I'm seeing them on Monday next week.

Would he qualify for a second adult rebate on the Sister's council tax due to his low income?

I don't know much about this type of rebate so would have to check and i'm leaving work in 10 mins for a long weekend so can't.

I think that if she can get a second adult rebate for him he can claim the funeral payment.
