DLA appeal - urgent!!
Mon 19-Dec-05 09:17 AM

Hi,

I have an appeal coming up this afternoon for a blind person currently on low care, we are seeking middle rate. He mentioned to me yesterday he had information from someone to suggest that if successful it could be backdated to 1994. Now I know he's referring to Mallinson, but I'm not sure about this backdating issue. Is there any special provision that I've not come across, or are we limited to the date he requested the supersession?

Many thanks in advance for any info.

Hello again:

Sorry forgot to mention that the provisions you need to approach the issue ( apart from the CD - see last posting) is reg 7(6) of the SS CS (DA) Regs and sec 27 of the SSAct 1998.
