Asylum decision and HB entitlement

My client was refused asylum in Jan 01. The HB authority continued to pay him HB and CTB which has now been declared overpaid. In November 2002 my client was granted asylum status.

Is the authority correct in pursuing recovery of the overpayment?

If he claimed HB within 28 days of him being notified of his refugee status he would be entitled to HB throughout the period.

I dont think the LA is entitled to pursue recovery
