Working Tax Credit and the Disability Element

Difference of opinion in service. Can you help.
Confusion over what circumstances allow the inclusion of a disability element in
the calculation of Working Tax credit. Does the employed person in a joint
claim need to be the disabled one or is it sufficient that a non employed
partner in the joint claim is the disabled person. The Legislation appeared
unclear and seemed to suggest potentially the non working partner could be the
disabled one. Further believe that the WTC Entitlement and Rate Regs were
amended to clarify thet the WTC claimant has to be the one to satisfy the
disabilty element (think this was the WTC Miscelleneous Amendment no 2 Regs)
Confirmation or clarifacation would be helpfull.
