DLA COOKING TEST

I know I saw a CD recently which discussed the suggestions put forward by tribunals regarding the use of perching stools, slotted spoons etc - the gist of it was that the application should be considered on what was available as to what could be used: unfortunely I didn't download it at the time ans so does anyone recall it please ......

Could it have been CDLA/1212/2005?

In this decision, Deputy Commissioner Mark holds that it is not relevant to the cooking test whether a claimant does, or does not have, a microwave oven or other standard kitchen equipment and cites the House of Lords' judgment in Moyna that held that the cooking test is a purely hypothetical method of calibrating disability.

Thanks Ken - quite helpful, but the one I was thinking of which I've now found on OSSC site is CDLA/4958/2002. The attraction of this one is that it neatly circumvents any "helpful" suggestions emanating from DM's and/or Tribunalks that using a slotted spoon obviates the need to lift pots and pans, with the accompanying risk of scalding/spillages etc.

Commissioner Williams, whilst not actually disgreeing with the use of such a spoon, then goes on to ask the seemingly obvious question: who exactly is going to put the pans on and takes them off the cooker, if the claimant has difficulty doing so themselves. The simple logical approach is always the best don't you think..........
