CT liability on empty property
My client has purchased a property using funds from a PI award and it is being adapted due to their disability. In the meantime they are living with parents who are providing care. The council has placed a 100% liability on the empty property. They have refused exemption under Class I. Is there anything we can do?
Thanks
The normal route is raise a ‘grievance’ with the council, then apply to the Valuation Tribunal if still disagree.
Note that Class I requires that the property had been the payer’s sole/main residence before they had to move out. It also requires that the reason for the move is to get care, rather than to allow for repairs.
Thank you for the reply.
