JR challenge on government’s failure to protect care home residents from risk of serious harm or death during pandemic
Gardner & Anor, R (On the Application Of) v Secretary of State for Health and Social Care & Ors - In this judicial review, the Claimants challenge what they say is the Defendants’ - Secretary of State for Health and Social Care, NHS commissioning board and Public Health England - failure to protect residents of care homes in England from the risk of serious harm or death from Covid during the first wave of the pandemic between March and June 2020.
An initial hearing dealt with admissibility of expert evidence of opinion, but the substantive hearing is due to take place over six days from 14 March 2022.
