UC to pension and pension credit
Thanks Paul, I understand that, I can’t remember what I was thinking now. Will the overpayment date from the start of the first AP after she reached SRP age?
We’ve not had any cases of DWP trying to recover UC overpayments so not 100% but I think that should be the case.
As with Will’s client above, I would simply get on with getting the SP, PC and HB claims made asap, seek full backdating and see what happens and if they do chase your client, you could seek a waiver of the overpayment.
Your client should be still within the 3-month window there so if she does receive backdated payments of these benefits, then it’s probably wise to warn her to put some aside to potentially pay back any UC overpayment (as we’ve seen on other threads, it doesn’t seem as if they can offset arrears of non-UC benefits in cases like these for some reason).
