Tribunal’s duty to make fresh finding of fact
I’m looking for a decision which sets out the principle that a judgment which amounts to a review of the original decision is wrong in law, and falls short of the fresh finding of fact that the Tribunal ought to have made. Can anyone help?
The foundational case of R(IB) 2/04 and ‘standing in the shoes of the decision maker’ etc.
