right to reside PC
HELP please, I have cl with tribunal looming close, Poish citizen, mother later arrives in UK, mother claims PC but refused , cl works but has very thin evidence of practical support provided for his mother, needs to show she is dependant on him. apart from cash what can go to show dependancy in right to reside cases ???
judge jacobs decision in CIS/2100/2007 sets outs factors to be taken into account in assessing dependency -
here’s link to briefcase summary -
http://www.rightsnet.org.uk/briefcase/summary/Right-to-reside-whether-claimant-dependent-on-son-
and decision itself -
Is it a plausible argument that a claimant could be self sufficient financially but dependent for the purpose of a right to reside ?? seems an odd idea but if support does not haveto be financlai presumably both scenarios could appply at the same time !!! any ideas please
hearing was adjourned for Pension service to attend and to consider new evidence Pension Service backed down when asked to attend a new hearing, PC was awarded from Jan 2011
