nepal no recourse to public funds
clienty us UK citizen age 84, wife is Nepalese, she ha sno recours ein visa, cl gets DLA and wife wants to claim carers allowance and UC and council taz relief and any other benefits she can,
I advised she should not claim these at all due to visa restrictions
is this correct, can she claim any UK benefits at all ?????
Not any of those, but assuming this is a mixed age couple (you mentioned UC as one of the things she is interested in), the older partner can claim means tested pensioner benefits (SPC and, if renting, HB) as a single person, and can claim CTR in the claimant role (the partner does not make a joint claim for CTR).
There is a slight risk that by the older partner claiming CTR on full, non-discounted Council Tax the younger partner could be seen as having indirect recourse to public funds.
thanks HB, CTR sounds a bit iffy !!!
