Posthumous carer element addition
I have a case where a client had a joint claim for UC but the partner sadly passed away in Feb 24.
Client also had an appeal running for PIP which was heard on 10/04/24 and was successful, with an award of the DL component commencing from 13/05/22. Now the tribunal decision has been put into payment is it possible to ask UC to add the carer element in respect of her partner caring for her up until his death? This would only put client in the same position as she would have been in with her partner had DWP awarded her PIP correctly in the first place.
I can see no reason why the Carers Element should not be paid subject to the deceased partner satisfying the conditions for entitlement.
They’ve just posthoumously awarded the Carer Element to my client. No questions asked and a few months after his wife died. She had been in receipt of PIP before she died but he hadn’t reported the caring.
Thanks for the replies. We have requested the carer element today so will see what happens.
