PIP eligibility
Hi there,
I have a client who has got back to the UK on 23/06/22 after living in Australia for 7 years. He is a British Citizen.
He states that he has been able to make an application for PIP and they have sent out a form, due back in October.
I can’t see why they have allowed him to start the claim as the eligibility criteria states you have to have lived in the UK for the last 2 out of 3 years.
There is nothing in his circs to indicate that he can make a claim: separating from wife, has sole care of his 2 daughters who are special needs children but cannot make a claim for Child DLA yet due to that eligibility criteria, they are no in school yet and he has not made an application for Child benefit yet.
I can’t think of why he would be exempt from the rule, he states that the adviser on the phone did go over his time in Australia.
I think I’ve covered everything. Any help/advice is appreciated thank you!
Perhaps they’ve sent him the PIP1 not the PIP2. PIP1 is where info about past presence is gathered so wouldn’t be precluded from getting this.
Past presence has exemptions. I presume those have all been worked through?
