Client has been told that needs to claim UC as ESA has to stop as she has moved from N Ireland to England
My client is a British Citizen who lived in N iRELAND FOR ABOUT 15 YEARS. She has moved back to England this June. She was in receipt of IR ESA and PIP. ESA has stopped and she’s been told to claim UC. Any advice would be appreciated will her PIP continue? Also should her IR ESA continue as change of circs rather than needing to claim UC. She will have to claim UC soon as no entitlement to HB so will need help with rent but if she has Support Group and SDP in ESA then if should remain on this then could argue this and then she would get Transitional protection SDP and LCWRA
From what I have found so far I was thinking PIP and IR ESA should continue as she is not a person subject to Immigration Control as she is a British Citizen with a Right to Reside and been habitually resident in the common travel area? Reciprocal Agreement??

This was my query so I’ve jumped back on to say the ESA claim did transfer successfully in that case but I had to involve the DWP Partnership Manager to get it resolved.
