Is Social Security Scotland subjected to the Kerr principle?
Given that Social Security Scotland (SSS) are a department of the Scottish Government but had not yet been established when the case setting the Kerr principle was held, do advisors think the Kerr principle should also place a duty/power on SSS to ascertain information from other UK government Departments such is HMRC and DWP when a claimant is unable to provide the information and the other Government Departments holds this info?
