Disability support payment
The Additional Payments Act states (s5(1))
“The Secretary of State must secure that a single payment of £150 (a “disability additional payment”) is made to each individual who is entitled to a payment of a disability benefit that is payable in respect of 25 May 2022.”
I’m wondering if the words “entitled to a payment” excludes those whose benefit was suspended at the time as they were in hospital or a similar institution.
Or does the fact that they are still entitled just not getting actual payments mean they will get it?
The explanatory memorandum is completely silent on this issue, other than parroting the wording in the section.
As it does state “entitled to a payment”, that does appear to imply that for people who have an entitlement to a qualifying benefit but that isn’t being paid for the reasons you cite, they wouldn’t be entitled to the extra payment. As we all know, there’s a big difference between being entitled to a benefit and being paid the same benefit.
Thanks Paul. Yes, the Act itself and the memorandum are very sparse on detail. At least these aren’t due to be paid until “from September” whatever that means so hopefully we might find out by then.
