parent has different immigration status to child Mon 07-Jun-04 02:56 PM
Can a parent who has ILR claim CTC for children who have not had a decision on their immigration status? Children arrived separately to mother and have not yet had a decision yet. It looks as though parents in this situation used to be able to claim IS for their children (haven't got the exact reg to hand). is there a similar provision for CTC & WTC?

My understanding is the TC position is identical to the IS position as regards an eligible person claiming in respect of children who are subject to immigration control. CPAG certainly believe this and there's nothing in the TC (Immigration) Regs that appears to indicate otherwise.
