Hello I am currently involved in an appeal regarding a young man who has had a 8 week sanction placed on the remainder of his JSA conts claim. This is because he failed to show just cause as to why he left his job voluntarily. The upshot is this man had a partner diagnosed with cancer, during this time she lost a baby at 6 months gone. He then walked out leaving the family home for 3 months and his job unotified. He claims that he repeatedly spoke with the employer about his situation (including problems he was having with his back and lifting heavy goods) he states that he found his employer unsympathetic and stopped communicating with them about his personal and health circumstances. He did not speak to his GP about his situation but the partner did as she was anxious when he left the home for 3 months. The DM on this states there is no just cause as to why he left the job - they have spoken to the employer who seems largely unaware of the mans situation. Any useful caselaw decisions etc on just cause I can be pointed in the right direction of? I have advised him to speak to the GP to see if he can confirm the above details. Regards Caroline
