We act for a divorced woman with one dependent child. She receives Income Support, Child Tax Credit and Child Benefit. She has no other grounds to receive Income Support other than as a lone parent.
Client and husband have `shared care` of their son (he spends 50% of time with mother and 50% of time with father). The ex husband is working and wished to claim tax credits, in particular the child care costs for when the son was living with him.
His inital offer was to claim the Child Benefit and to give this to our client (he then being able to automatically claim the benefits as being `responsible` for the child. We advised that this could have some serious consequences for the Mothers income and as such she did not give him permission for this.
Father has now applied for Child Benefit and client been told that an investigation is proceeding. We hope to show that the CB should remain with our client.
Is it possible for 2 people to claim Child Tax Credit for the same child? would Hockenjos allow Father to claim for periods son lives with him, whilst not affecting our clients benefit entitlement.
