Can anyhelp me to find R(I)1/89? I have tried all the usual sources but I am having no luck.

The case relates to s34(4) of the Social Security (prescribed diseases) regs 1985 which concerns the assessment of the 80% deaf requirement for HRM (blind and deaf.) and in particular the power of tribunals to depart from the strict assessment of %disablement in sch 3.

Client is 100% Blind and 74% deaf (!) but his hearing is subject to a degenerative disease

try the OSSCC web site and email them they usually send an electronic copy back next day.
