As the regs stand in themselves, no chance. However, a couple of previous posts on this forum suggest there *may* be a HRA argument on the grounds that HBR 7(1)(c) discriminates against women (as, allegedly, the proportion of women who fall foul of this regulation is way out of kilter when compared to men).
I'm not an HRA expert, but so few HRA challenges have been successful that it seems you need one hell of a case to win.....
