HB landlord former partner

I'm sure I'm on a hiding to nothing as per HB Reg 7(1)(c)but hold my breath hoping for some divine inspiration. Client claimed and correctly awarded one year's HB for property owned by landlord Mr X. Moved out and into different property/landlord. Then moved back into original property WITH landlord Mr X. He left and she remained and claimed HB again. Refused under above reg.
Cat in hells chance I assume?

As the regs stand in themselves, no chance. However, a couple of previous posts on this forum suggest there *may* be a HRA argument on the grounds that HBR 7(1)(c) discriminates against women (as, allegedly, the proportion of women who fall foul of this regulation is way out of kilter when compared to men).

I'm not an HRA expert, but so few HRA challenges have been successful that it seems you need one hell of a case to win.....

Findlay has references to a couple of cases where the HRA argumnent was tried and rejected.
