Ombudsman
Mon 25-Jun-07 08:00 AM

We recall in the dim and distant past that the Local Government Ombudsman has commented on the duty of social work staff to identify welfare rights advice needs - can anyone direct us to the reference or send us a copy of the decisions?

Thank you.

The reference you want is complaint 93/A/3738.

East Sussex Council failure of visual impairment officer to advise on
welfare benefits. Council to compensate by full amount of unclaimed benefit.

I have a summary from Journal of Social and Welfare and Family Law that I can fax if anyone wants it.

Hi Paddy. Also 'Fairer Charging' legislation requires social services authorities to provide advice about benefits.

Further to the point made by jimmckenny, the DoH Fairer charging policies for home care and other non-residential social services practice guidance is available here.
