dla anytime reviews
Fri 30-Jan-04 01:26 PM

it is over two years since i represented a young man at a tribunal to increase his dla cc from lr to mr at that time he was in reciept of a life long award of hrmc. To cut a long story short we were successful in getting the lrcc increased to mr but the life award was reduced to the same time award as the cc. I would like to know the best way forward in regard to getting both components awarded for indefinate periods as I know that life time awards are now a thing of the past.
I recently completed a renewal form for a young man with ADHD/depression and he was awarded hrcc lrmc for an idefinate time.
Both these young men have life long conditions and will have their problems throughout their lives any suggestions will be extremely welcome
thank you in advance Jimmy

I've never done this, but according to the Disability Rights Handbook you can dispute any aspect of a decision including length of award. I'd make sure I had really good medical evidence before I tried it though! I have also heard of tribunals making negative decisions not because someone has got better but because in the tribunal's view they have 'learned to adapt' to their condition so you need to pre-empt that one as well. The caselaw on this earlier posting may help you with a request, but I fear only at appeal or higher stage:
