Does anyone know what rate of LHA joint tenants should receive if they are over 25? I think they should get the shared accommodation rate but am not sure...

In Derbyshire Dales the Benefits Manager (who is a lovely man) gave us a briefing before LHA came into force and according to the notes I took 1 bedroom is allowed for each person over 16, unless your clients are a couple in which case they are allowed one between them.

So adult joint tenants should get the local rate applicable to a 2 bedroomed property. Unless anyone out there knows differently....

any individual in any kind of shared accomodation (inc jt tenants) will only get the shared room rate. According to DWP guidance anyway

Unless the claimant qualifies for a severe disability premium, in which case they will get the one room rate regardless of the fact they live in shared accomodation.

However, the general premise is that joint tenants without children will only get the shared room rate.

I stand corrected, and disappointed as well. Were you quoting from the regs there, St Alban's Ben? I haven't got the up to date law books here yet.

I would have thought that if you added up the single room rate for each person then it would be more than the amount for the house as a whole. For example four single room rates would be more than the rate for one claim for a four bedded house, so it isn't particularly unfair.

But they will get the one-bed self-contained rate if they have exclusive use of 2+ rooms.

Not the case in this locality:

Shared Room = £355.53 per month

4 Beds = £1600.00 per month.
