Recovery of social fund loans in bankruptcy Thu 18-Nov-04 05:59 PM
Client works, teenage child, gets CTC and Child Benefit; has serious debts and considering bankruptcy. Debts include social fund crisis loan. This loan will have to be included in the bankruptcy. I know DWP are then able to collect the debt by deduction from ongoing benefits, but am not sure whether this is limited to benefits administered by DWP. Do they also have the right to collect by deduction from CTC, or Child Benefit? I would be grateful for any advice on this.
