hi again to all ...
have a cl. whose exceptional leave to remain in the uk expired on 09/01/07. on 13/12/06 cl. applied for indefinite leave to remain (iltr) in uk but has not received a decision yet.

rang home office who have said a decision on cl. appl. for iltr can take between 4 - 14 weeks (ha - ha -ha) so can cl. continue to receive i.b.j.s.a, h.b / c.t.b until a decision is made on iltr application, or does he need to seek help from nass ?

as ever, all responses greatly accepted and appreciated.

S3C of the Immigration Act 1971 provides that if you apply for leave to be extended/varied before it expires, then the leave continues until a decision is made on the application. So your client still has ELR until a decision on the new application is made.

The problem with benefits is usually proving that you have made the application in time. DWP often insist on confirmation for IND. Applications are not routinely acknowledged, and although they will confirm things if you ask, it can take weeks.
