German national & right to HB (HRT)

Hello,
I work for a Housing Association providing accommodation for 16-25 year olds. A 21yr old German national has approached us for accommodation but we need to clarify if he is likely to be entitled to HB before we can help him. He came here in 2005 & I believe he was initially a student. He is now employed but is only working 14 hours per week earning £72. I am wondering if he will fail the habitual residence test as he is only working part-time.
Can someone advise me please.

I would say that he is an EEA worker and derives his right to reside from that. The HRT does not apply. The rules do not specify how many hours have to be worked - only that the work should be "effective and genuine", presumably to stop abuses whereby people contrive to do some sort of activity just so that they can claim to be EEA workers. So long as it's a genuine job I would say that he is eligible.
