Normally Reside for SDP

I know this has been asked before but could not see a question that was simillar to mine.

A client claims AA, lives alone, though has a son living with them, who has there own home, that cares for his mother over night every night. Am i correct in thinking that she would not be entitled to the SDP? he doesnt claim CA, yet.

Son would not count as a non-dependent if he "normally" lives elsewhere. According to Disability Rights Hand book there is no legal definaition of "normally resides" CIS 14850/96 and CSIS 100/93 provide guidence. Worth arguing I'd think!

Proof of payment of Utility bills, rent, council tax at his own address should suffice to show that his normal residence is elsewhere.

ok, had a look there and thats all i could find. He has his mail directed there also, not sure if that would go against the client also
