Client claimed IB using ordinary claim form, DWP sent IB-Y claim form to him which he completed and returned. Then got decision stating not entitled to IB because insufficient NI contributions. Was well outside 1 month when I first saw him. Requested any time review on basis they applied wrong qualifying conditions - local office refusing even to acknowledge request (separate issue which I am dealing with) but did kindly inform me over the phone that because client failed to submit a backdated sick note with the claim they "automatically" treated it as a claim for normal IB. Client has savings over £8,000 so can't go down IS route. Comments/suggestions?
