Disabled worker element - backdated to bring within time limits

Single person aged 50 working 16 hours a week.

No DLA in payment at present.

Was getting IS with disaility premium upto Nov 2004 when she started work.

She can pass the 'disability test' but can she pass the qualifying benefit test ??

My understanding is that she needs to have been getting IS with disability premium within 182 days of claim to qualify.

If she made a claim today, she would be outide this time limit.

However claim can be backdated 3 months - does this mean that it is treated as made 3 months ago and therefore when she is treated to have made the claim is witin 182 days of her being on IS with disability premium so will qualify.

Or am I totally on the wrong track???????
