EMA - 'home student' criteria

Does anyone know what the 'home student' criteria are for education maintenance allowance.

Google searches only show up references inviting people to visit home office website for details, but I was unable to find anything there.

Client has failed right to reside, but we expect an appeal to be successuful. Trying to maximise family income.

I had occasion to dig out the EMA Regs a while back and boy did it take some doing. I had some help from S Lloyd also. As far as I am aware the only substantial EMA Regs still in force are the 2000 Pilot Regs, which have since, been rolled out across the country, SI 2000/2012.

There is no definition of home student in the regs but the same conditions apply to all students, residence, parental income etc. The key will be in the learning agreement, which will specify what the LA expects from the student a breach of which can lead to EMA being withdrawn.
