A8 and Worker Registration

Hello all,

Could someone clarify this for me - A8 national started work on 27/06/05 but did not register until 15/08/05 ( Registration Certficate dated from this date ) - can you count work before registration at all, or only 30 days prior to registration ( though in this case she did not register within 30 days of starting work ).

Also is the year required under Registration interpreted strictly eg if registered from 15/08/05 would it have to continue to 15/08/06?

Finally, has anyone had experience of evidence required by DWP if A8 national asserts they are self employed?

On the last point I have come across checks being made with HMRC to see if they are registered for and paying Class 2 NICs.

Hi

Unfortunatly the client will only be classed as legal working from the date of issue of WRS certificate, this is due to it not being done within the first 30 days. You will find the DWP and WRS are very strict on this.
DWP do check with the Home Office, to clarify date registered.
Also, if the client breaks employment for more than the 30 days during the first year he must inform CTC, WTC, CB, HB and CTB. After 30 days of not working the client is no longer entitled to in work benefits and will have overpayments.
