New regulations have been issued that remove the need of certain A2and A8 nationals to register for work under the Worker Registration/Authorisation Scheme.
In force from19 November 2007, the Accession (Worker Authorisation and Worker Registration) (Amendment) Regulations 2007 (SI.No.3012/2007) -
- exempt A2 and A8 nationals who are family members of A2 or A8 nationals who are self employed, self sufficient or students with a right to reside from the need to register for work; and
- exempt A2 and A8 nationals who are members of a diplomatic mission, the family members of such a person or are otherwise entitled to diplomatic immunity from the need to register for work.
In addition, the new regulations update the definition of 'highly skilled person' to include someone with a degree, postgraduate certificate or postgraduate diploma awarded by a relevant institution in the UK. Bulgarian and Romanian nationals who fall within this definition will also be exempt from the need for worker authorisation.
