doubt over GP medical evidence right to fair hearing time allowed to dispute med evidence
Mon 21-Mar-05 10:27 AM

I took a client to appeal hearing. the day before just received GP Medical evidence which my client said was totally wrong the GP had not checked his records to give dates when my client had had consultants reports done on his medical condition. My client on receipt of report complained to his sugery. At the hearing the Chair asked to see the report despite me saying that it was not accruate and that he was disputing report with surgery. The EMP report was in favour of my client.
We were not given oppurtunity to adjourn the appeal was disallowed. Written statement of reasons sent for. Chair favoured GP report dismissed clients evidence and EMP report.
I need to find commisionsers decision relating to having a fair hearing Tribunals reponsibility to look at all evidence as a whole the right to have hearing adjourned to get accurate evidence etc.
Can anyone help please
