Our client reached an out of Court settlement for compensation for an industrial disease some months ago. His disease only manifested itself after retirement, and he had never received any benefits to compensate for his illness, so no compensation recovery. This week he won an appeal tribunal for a prescribed industrial disease and IIDB will be backdated for more than 3 years. I've trawled through the legislation on compensation recovery of benefits, and cannot find any reference to recovery of benefit paid AFTER settlement. Can it really be true that he gets to keep all his compensation and his IIDB?
