CTB for those turning 18

Hi all

A resident, aged under 18, moved into one of our self-contained flats earlier this year and put in a claim for HB/CTB. HB was awarded. The resident then turned 18 and remained resident at the property.

We have just discovered that they became liable for Council Tax in the week they turned 18 and have built up CTax arrears. The LA have said they would have needed a new CTax claim in the week they turned 18 to award backdated.

Should the LA process CTB based on the original HB/CTB claim - i.e. is a new claim really necessary?

You say he claimed HB/CTB. Is that specifically what it said on the form? Was the claim made within the last 13 weeks?

If the answer to both these question is yes, then they already have a claim made in advance within the appropriate timeframe. If not then they probably have a point.
