Child is with severe disabilities is accommodated by the LA, with a view to eventually returning home. Child is in foster placement.
At the moment child is staying over night at Mother's one night per week.Has been absent for more than eight weeks.
I've looked at CPAG and note the additional absence from home rules that may apply. This applies to "..certain forms of residential accommodation.."
I can not find this provision in the regs - it seems to come from a Comm's decision.
Does anyone know of the definition of 'residential accommodation' in this sense, and also who would have to make the declaration that that the child's health would have deteriorated had they remained at home, and if there is any case law defintion to help with this.
