E MAILS AS EVIDENCE FOR APPEALS
Tue 17-Apr-07 09:04 AM

We generally ask social workers, support workers, etc to provide signed letters we can use as evidence for appeals. It would be quicker/easier if they could reply to our enquiries by e mail. Does anybody know if the authenticity of unsigned e mails has ever been challenged by tribunals?

I've succesfully used unsigned e-mails in both PCA and DLA appeals - never had a problem from a tribunal. Any challenge would, I think, be more likely to come from the Department, though even then should only result in the tribunal ordering an adjournment for verification purposes. If evidence were rejected entirely, without your being given the opportunity to provide verification, you'd have little problem obtaining a set-aside.
