High Court - Mr Justice Wilkie

Mrs Atkinson suffers from Dementia, Parkinsons Disease, Angina, Osteoporosis and deafness - she moved into nursing home care in 2004 but had to meet her own costs. Her case was that the care she required was nursing care, as opposed to social care. Plymouth Teaching Primary Care trust disagreed.

Following the ruling by Mr Justice Wilkie, the Trust is going to repay £43000 to Mrs Atkinson, and will pay future fees.
