Not my area - please advise...
Mon 14-Nov-05 11:01 AM

Hi all, im a debt adviser so not too hot on tax credits overpayments and appealing a decision to recover.

My client is on DLA care and mob, she is in a wheelchair and has a lot of health problems. As well as having debt advice she is also receiving tenancy support as she is a vunerable tenant.

She lives with her three children.

The claim for tax credits was made by her then partner, he filled in the forms although I dont know whether just hi or both signed them.

He has now moved out and my client has been informed by the IR £750 overpayment.

DOes anyone know the best way to challenge this? I am worried that if I say to them that he filled in the form, they will just argue that she should have been aware of what he put on the form...

Do I have any standing to argue this, we know his address, can they not chase him rather than her instead, any help would be appreciated, but please in words of one syllable......

As it is such a specialised area, you're probably best off referring your client to a specialist benefits/tax credits adviser - there is a comprehensive list of local agencies on Manchester City Council website/
