IBS DLA Appeal - Any relevant caselaw known of?
Thu 19-Jan-06 04:42 PM

I have a DLA tribunal coming up on the 3rd of Feb.

The only illness is severe IBS and I am looking at Lower Rate Care on the Cooking test for a variety of reasons.

The medical evidence is non-committal around his ability to cook - principally because they feel unable to comment on the client's domestic agenda.

Any ideas on case law around IBS gratefully recieved.

An exact phrase word search for 'irritable bowel syndrome' (with DLA as the benefit type) in rightsnet briefcase highlights summaries of three commissioner decisions -

CDLA/3612/2003, CDLA/3831/2004 & CDLA/902/2004.

However none specifcally relate to the cooking test.

A similar briefcase exact word search for 'cooking test' highlights summaries of 14 decisions outlining how commissioners believe tribunals should go about considering whether or not the cooking test criteria are met.
