An unusual and rather sad case. Clients wife was terminally ill with ds1500. Dla forms were issued dated from 9/11/05. wife was admitted to hospital on 1/12/05 and died that evening, long before anyone expected her to. Because client had not taken DLA forms to the hospital someone there used an undated claim form which was sent off with a second DS15. DWP are now not paying any DLA as claimant had already passed away before they recieved the form. Professional helpline said that there was no point filling in first form even though it is still within the six week period.
I think that the first form would still be valid for the period 9/11/05 to 1/12/05 and if it were to be submitted the second claim would then have to be treated as a supercession even if the award was exactly the same and on the same grounds, terminal illness. Can anyone think of any reason why this isn't possible, or have i missed something obvious?
