Student and non dependant deduction rules.

Hello,

I have a client who is self employed and on a low income, so gets full HB at the moment. her daughter started university last September, but has now begun work of around 4 hours per week ( Sometimes a little more, but under 16 hours). Therefore she is not in renumerative work. Will this affect my clients claim? The clients daughter has obsessive compulsive disorder and gets very distressed easily, so my client wants to avoid having to take her to the HB office etc if possible with wage slips. I thought the claim may only be affected during the holiday periods when students are expected to find work. Ihave been looking at the regs but I still find it confusing!

HBR 74(7) applies.

So long as the non-dep is not in remunerative work (i.e 16 hrs or more per week) AND is a full-time student (defined), no deduction is made.
