I.S and Occ Pension

Hi, I have a 51 year old lady who gets Incapacity Benefit with a small top up of I.S. She remembered about an Occ Pen that she paid into many years ago and contacted the company. She has been sent a forecast which, if she takes it will mean it takes her out of I.S by just £1pw.

I realise if she takes it she must declare it and take the consequences but my problem is her knowledge of this pension. If she decides to do nothing and it won't become payable until she's 60, is she depriving herself of income. I've checked CPAG but feel it gives conflicting info and I want to be sure before I advise her.

Any help gratefully received.

Generally income available on application is treated as notional income, but an occupational pension available on application is ignored if the person is under 60. See Decision Maker's Guide para 28594.
