Can anyone help me with query?
Comments: I have a client who was receiving incapacity benefit and had a personal capability assessment and the result is his case was refused. This has resulted in a reduction in his benefit to £44.50. As he is aged over 25 I cannot understnd why the rate is so low.
Is this a new law as the DWP state because he has appealed against the decision.

If your client was actually receiving incapacity benefit(IB) up to the point that he failed his PCA this will have stopped altogether. The rate that you quote is income support paid at a reduced rate that is only appropriate for people who have appealed against the PCA decision.£44.50 is 80% of the aged 25 and over applicable amount of income support.
If he was receiving income support because he had no entitlement to IB anyway (e.g. not enough NI contributions)he would still only be able to get the reduced amount if he appealed against the PCA decision.
